TRAINMENOW – TERMS OF SERVICE

Welcome to TrainMeNow (“TMN,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our services, including personal training, fitness programs, group classes, and access to our mobile application powered by Trainerize (the “App”).By accessing or using our services, you agree to be bound by these Terms.

You must be at least 18 years old or have parental/guardian consent to use our services. By using TMN, you confirm that you meet this requirement.

TrainMeNow offers:

• Personal training sessions (in-person and/or virtual)
• Fitness programs and coaching
• Group classes
• App-based training, tracking, and communication

Services may vary depending on your membership or purchase.

To access certain features, you must create an account through our App.You agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your login credentials
• Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts for misuse or violation of these Terms.

Memberships are billed on a recurring monthly basis, typically around the 1st of each month, to maintain a consistent monthly schedule. Payments are processed through secure third-party providers (e.g., Stripe). By subscribing, you authorize automatic recurring payments.For clients not enrolled in automatic payments, timely payment is required to maintain scheduling consistency. Late payments may result in missed training weeks within the current billing cycle.Add-on sessions and programs:

• May be purchased separately
• Are non-refundable unless otherwise stated

Failure to complete payment will result in suspension of services, including loss of access to the TrainMeNow app. Any scheduled personal training sessions may be canceled until payment is received and the account is brought up to date.

• Membership cancellations require prior notice (typically 7–30 days depending on your agreement).
• No refunds are provided for unused sessions unless required by law.
• Failure to show up to a scheduled personal training session without prior notice will result in the session being considered used and therefore forfeited.
• Specific cancellation terms may be outlined in your Membership Agreement.

All content provided by TMN, including:

• Workout programs
• Videos and instructions
• Training materials

is the exclusive property of TrainMeNow.You may not:

• Copy, reproduce, or distribute content
• Share access with others
• Use content for commercial purposes

You agree not to:

• Use the App for unlawful purposes
• Harass or harm others
• Attempt to interfere with the App’s functionality

We reserve the right to restrict access for violations.

TMN provides fitness and wellness guidance only.You acknowledge that:

• You are responsible for your own health and safety
• You should consult a physician before starting any program
• Results are not guaranteed

Use of our services is at your own risk.

To the maximum extent permitted by law, TrainMeNow shall not be liable for:

• Any injuries, damages, or losses resulting from participation in our services
• Indirect, incidental, or consequential damages

This includes use of our App, programs, or in-person sessions.

Our App is powered by third-party platforms such as Trainerize.We are not responsible for:

• Technical issues
• Data loss
• Service interruptions caused by third-party providers

We reserve the right to:

• Modify or discontinue services
• Update pricing
• Change features of the App

We will provide notice when appropriate.

We may terminate or suspend your access if:

• You violate these Terms
• Payments are not made
• Behavior is deemed inappropriate or unsafe

These Terms are governed by the laws of the State of Massachusetts, United States.
